Roger Clemens' Lawyer, Rusty Hardin, Cleared to Remain on Perjury Case

Roger Clemens and Rusty HardinWASHINGTON -- Roger Clemens' lead attorney was allowed remain at his side, although the federal judge hearing the perjury and obstruction case against the seven-time Cy Young Award winner wanted to pass along a conversation that may have presented its own conflict of interest issue.

"I played ball with Ken Griffey Sr.," U.S. District Court Judge Reggie Walton said during the hearing on Wednesday. "Griffey said something like, 'I see you are (involved) in the Clemens case. He's a good guy.'"

Walton said he grew up in the same Western Pennsylvania town as Griffey and the slugger Stan Musial. The conversation occurred two months ago when Walton was back in Donora.

"I can't talk about the case," Walton said he told Griffey.

Neither prosecution or defense said they had a problem with the conversation. Walton said he brought it up because there was an issue earlier in his career as a local judge that an appeals court admonished him over.
